As far as the Montford case is concerned, don't be so quick to judge. If you want to feel anger toward those sisters, I will let you spend 10 minutes caring for my mother and then we can see how you feel. In our society, the caregiver is always the guilty party.
Dude, the mother was infested with maggots. I know that caring for a paraplegic relative is hard, but seriously. Sometimes people need to be judged.
Maggots? If I ever end up with an untreated wound and refuse access to medical care, I pray to the God above that the maggots show up. The medical community has been using maggots to destroy dead skin cells and reduce infection since the dawn of time. Doctors have only quit using maggots in the last 100 years.
Here you can read more about how maggots are as good as gels in leg ulcer treatments.
So the sisters were doctors administering a maggot treatment to their mother?
And is sitting in your own feces another medical treatment that doctors have quit using?
If your mother refuses treatment or aid, who do you call? The police? EMTs? Fire Department? What are they going to do once they get to your home and you show them mom sitting in her own feces and not letting anyone touch her?
Last I check we have the legal right to sit in our own feces and not let anyone touch us. This is a bigger gray area than one would suspect. I've already told my mother that the next time she scratches or bruises me that I am going to put picture of it on the Internet so that I can have some evidence when I inevitably need to defend myself in a court of law.
Cham:
If a person is rotting away with massive bed sores you most certainly can call 911. The system generally recognizes that people who're rotting away in their own waste aren't entirely competent to make their own medical decisions. I understand that elder abuse can be a legal gray area, but when a person has huge bed sores and is lying in their own shit it's not a gray situation.

What you may not realize is that there are a lot of people out there that are in their homes, sitting in their own feces and that have bed sores. The difference in this case is that the defendants were getting paid by the state to care for their mother which would lead me to suspect the have some culpability.
Now if you have a person who wants to sit quietly in their own feces does that make them automatically incompetent and they require a legal guardian? How does the state and the lawyers know that someone is sitting in their own feces unless someone makes a home visit?
Any sensible person should know that persons suffering from dementia most probably would not be able to make reasonable, rational decisions for their own safety.
Fighting with, hitting you, sitting in feces to the point of bedsores: all are factors which suggest a higher level of care is needed. There are nursing homes skilled in handling these kinds of patients.
If she is not under the care of a social worker or physician, perhaps dss can help. There is a unit of elderly protective services.
er, Buz, I think she is under the care of a higher power at present.
